CONDITIONS FOR USING THE SMART SOCIETY STARTERK!T

We (Foundation Dutch Institute for Technology, Safety and Security) or our legal successor grant anyone who obtains a copy of (or a part of) the Smart Society StarterK!t free of charge a perpetual, irrevocable and worldwide right to use the Smart Society StarterK!t under the following conditions.

You agree that we will retain and use your name and contact information for the purpose of contacting you to inquire about your experiences with the Smart City StarterK!t. Or to keep you up to date with new developments concerning the Smart City StarterK!t.

You declare your solidarity with and embrace the open data principles and the IoT Charter. These principles are part of the Smart City StarterK!t and can be downloaded from http://www.smartcitystarterkit.com.

You acknowledge our investment in time, money and skills in setting up our Living Lab Stratumseind 2.0 and developing this Smart City StarterK!t. Notwithstanding the fact that we made a considerable investment, we do not ask form you any performance guarantee for these investments.

We can contact you with a request to inform us about the use of the Smart Society StarterK!t and the software components and applications and services built on them. You will make every effort to comply with such a request.

You are aware that obtaining a copy of the Smart City StarterK!t is an open invitation to discuss the joint further development of the Smart City StarterK!t with us. You understand that joint further development can mean significant cost savings for everyone who contributes. Plus: faster implementation of the following versions of the Smart City StarterK!t.

You make every effort to share actively with us knowledge, data, experiences about the use of the StarterK!t. You also make every effort to inform us on new software components applications or services that you have developed on the platform. We are allowed to use this knowledge, data and information for the improvement or adjustment of the Smart Society StarterK!t.

You are aware that, in collaboration with our partners, we are striving to achieve the vision of the municipality of Eindhoven to create a Smart Society, in which not the development of ICT is paramount, but the improvement of quality of life of people.

If you are using the Smart Society StarterK!t, you must comply with all applicable laws and regulations.

We are not liable for any damage caused by or in connection with the use of the Smart Society StarterK!t. This also applies to the partners who have participated in the development of the Smart Society Starterk!t. The Smart Society StarterK!t will be distributed to you “as is”. This means that neither we nor any other party who has contributed to the development of the Smart Society StarterK!t is responsible for the accuracy of the information in the Smart Society StarterK!t.

If you provide a copy of the Smart Society StarterK!t to a third party, you are obligated to impose these terms and conditions on the third party concerned. Upon request, you will inform us who you have provided a copy of the Smart SocietyK!t.

We may amend these conditions. We will send you the amended version of these terms and conditions. You will then have the choice to either accept or reject this modified version.

These terms and conditions are drawn up in Dutch and English. The Dutch language is binding.

Use of the Smart Society StarterK!t is governed by Dutch law. Any dispute which may arise out of or in connection with this Guidelines and any other document executed in connection with these Guidelines, or the breach, termination or invalidity thereof, which cannot be resolved in amicably, shall be finally resolved by the court in Oost-Brabant.
